Insolvency

Insolvencies are often complex undertakings that present practical and commercial problems. MFG has over the years acted for creditors, liquidators, receivers, and debtors of all sizes, whether in relation voluntary or involuntary proceedings.

We have provided advice on how to conduct liquidations and receiverships, how to resolve issues surrounding the sale of assets collected, including structuring the vehicle to facilitate purchase of the assets, as well as, assisted in effecting schemes of arrangement and compromises with creditors under the Companies Act.

MFG also has a deep understanding of and familiarity with the relatively new Insolvency law regime in Jamaica. Our attorneys were involved in leading the Private Sector Organization of Jamaica’s team which assisted in guiding the Joint Select Committee of Parliament in making changes to the insolvency framework in Jamaica which now aims to focus more on rescue and rehabilitation rather than punishment. MFG has provided training courses and presentations on this new regime, both in and outside of Jamaica, advised clients on the insolvency law implications in transactions and acted in precedent setting case law interpreting provisions of the Insolvency Act.
