Understanding Your Costs

Transfer Tax

Transfer tax is payable at the rate of 2% of the market/book value or the agreed consideration, whichever is higher. Transfer tax is to be paid by the seller.

Stamp Duty

Stamp duty is charged on the Agreement for Sale of Shares or Real Property. If the consideration is under J$500,000, stamp duty will be J$100. If the consideration is J$500,000 or more, stamp duty will be J$5,000. Each additional copy of the agreement will be J$10. Stamp duty is borne by the seller and purchaser equally.

Registration Fee

A registration fee of 0.5% of the stated consideration is payable for the sale of real property in order to note the transfer on the Certificate of Title. This is borne by the seller and purchaser equally.

*Registration fees may be abated in some transactions.

Other Closing Costs

For the sale of real property, other costs may include: (i) Realtor’s commission; (ii) Seller’s and Purchaser’s half cost of the Agreement; (iii) Seller’s and Purchaser’s half cost of the letters of possession and letters to utility companies.
